U.S. Customs and Border Protection (CBP) published the ISF Interim Final Rule in the Federal Register on November 26, 2008 making the law effective 60 days from the publishing. The law became effective on January 26, 2009.  There are 10 data elements that must be transmitted to CBP either via AMS (Automated Manifest System) or ABI (Automated Broker Interface) a minimum of 24 hours prior to the vessel sailing from the foreign port of lading to the USA. This can be done directly by the importer if they have access or through the importer’s "agent." We at OCEANAIR are ready to be your agent and process this filing for you. Effective July 9, 2013 U S Customs & Border Protection implemented “Enhanced Enforcement” of the ISF procedures. This began the implementation of monetary fines being issued for failure to file or late filing of ISF information as required. There are many consequences for non filing or late filing. You may experience delays, examinations, increased costs and in the worst case liquidated damage penalties.
